Every week the U.S. Attorney’s Office publishes press releases of providers who are being indicted, convicted, and sentenced for kickbacks. Kickbacks are not as easy to spot as you might think. Relationships often appear to be legitimate to the provider, but the government views them as illegal. Kickbacks take all sorts of forms. Most kickbacks are not brazen cash payments in a shoe box. On the contrary, most transactions prosecuted as kickbacks appear on the surface to be legitimate. For example, in the past 18 months alone, providers have been prosecuted for setting up MSOs, engaging in research studies, executing consulting agreements, being participants in research studies, entering into marketing agreements, creating charitable foundations, being speakers for vendors, signing prescriptions for telehealth companies, hiring-related individuals, providing gift cards, making lab referrals, and paying marketing commissions. None of these involved sneaky under-the-table cash payments. They were all designed to appear to be legitimate transactions. What about meals brought to the office? Are those kickbacks? What about gifts to referral sources? Are there amounts that can be legitimately given? Additionally, a new kickback statute was recently adopted, EKRA (Eliminating Kickbacks in Recovery Act), which expands kickbacks beyond just Medicare and Medicaid, and extends illegal kickbacks involving clinical laboratory services to commercial insurer claims. EKRA carries a 10-year incarceration term and addresses how you can pay both your employees and the 1099 sales team for the business they generate. New cases are starting to be litigated under EKRA, and those will be covered in this webinar. Additionally, there are numerous safe harbors under the kickback statute, such that if you legitimately fit within a safe harbor, the government is precluded from prosecuting you. Those safe harbors will be explored in this webinar.
